Dakyqoe - Drone Aerial Photography for Real Estate

1. Acceptance of Terms

By accessing and using Dakyqoe's drone aerial photography services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. These terms constitute a legally binding agreement between you and Dakyqoe. If you do not agree with any part of these terms, you must discontinue use of our services immediately.

2. User Obligations

As a user of our services, you agree to:

  • Provide accurate and complete information regarding property details and access requirements
  • Ensure legal authority to authorize aerial photography of the specified property
  • Obtain necessary permissions from property owners, tenants, or relevant authorities
  • Comply with all applicable local, state, and federal regulations regarding drone operations
  • Provide safe and unobstructed access to the property for our drone operations
  • Inform us of any potential hazards, restricted airspace, or safety concerns
  • Respect our intellectual property rights and not reproduce our work without permission
  • Make timely payments according to agreed terms and conditions

3. Service Limitations

Our drone aerial photography services are subject to various limitations that users must acknowledge:

  • Weather conditions may necessitate postponement or cancellation of scheduled flights
  • Federal Aviation Administration regulations and local airspace restrictions may limit operations
  • Equipment malfunctions or technical issues may affect service delivery
  • We reserve the right to refuse service in unsafe conditions or restricted areas
  • Flight duration and coverage area depend on battery life and regulatory constraints
  • Image quality may be affected by atmospheric conditions, lighting, or environmental factors
  • We cannot guarantee specific shots or angles due to safety and regulatory requirements
Important: All drone operations are conducted in accordance with FAA Part 107 regulations and local ordinances. Safety is our paramount concern and may override specific client requests.

4. Intellectual Property Rights

Dakyqoe retains all intellectual property rights in the photographs, videos, and creative content produced during our services. Upon full payment, clients receive a limited license to use the materials for their intended real estate marketing purposes. This license includes:

  • Right to use images for property marketing, listing, and promotional activities
  • Permission to share content with real estate agents, brokers, and potential buyers
  • Authorization to use materials on websites, social media, and marketing materials

Clients may not resell, redistribute, or claim ownership of the original content. Dakyqoe reserves the right to use completed work for portfolio, marketing, and promotional purposes while respecting client confidentiality where applicable.

5. Liability Limitations

LIMITATION OF LIABILITY: Dakyqoe's liability is limited to the total amount paid for services rendered. We shall not be liable for any indirect, incidental, special, consequential, or punitive damages.

Our liability limitations include but are not limited to:

  • Property damage caused by unforeseen circumstances or equipment failure
  • Lost business opportunities or profits due to service delays or cancellations
  • Third-party claims arising from our drone operations
  • Data loss or corruption of digital files
  • Injuries to persons or damage to property not directly caused by our negligence

Dakyqoe maintains comprehensive insurance coverage for drone operations and professional liability. Clients are encouraged to maintain their own insurance coverage for property and business operations.

6. Privacy and Data Protection

We are committed to protecting your privacy and handling personal information responsibly. Client information and property details are kept confidential and used solely for service delivery purposes. We implement appropriate security measures to protect digital files and client data from unauthorized access or disclosure.

7. Payment Terms and Cancellation Policy

Payment terms are established at the time of service agreement. Cancellations made less than 24 hours before scheduled service may incur charges. Weather-related cancellations initiated by Dakyqoe will not result in charges to the client. Refund policies are determined on a case-by-case basis depending on circumstances and services rendered.

8. Dispute Resolution

Any disputes arising from these terms or our services shall be resolved through the following process:

  • Initial attempt at good-faith negotiation between parties
  • Mediation through a mutually agreed-upon mediator if direct negotiation fails
  • Binding arbitration if mediation is unsuccessful
  • Legal proceedings as a final resort, governed by applicable state law

All disputes shall be governed by the laws of the jurisdiction where Dakyqoe operates, without regard to conflict of law principles.

9. Modifications and Updates

Dakyqoe reserves the right to modify these Terms and Conditions at any time. Updated terms will be effective immediately upon posting. Continued use of our services after modifications constitutes acceptance of the revised terms. We encourage users to review these terms periodically to stay informed of any changes.

These Terms and Conditions are effective as of the date of service agreement and remain in effect until superseded by updated terms.
